Sir:

Your Committee on Ways and Means, to which was referred S.B. No. 591, S.D. 1, entitled:

"A BILL FOR AN ACT RELATING TO OCCUPATIONAL THERAPISTS,"

begs leave to report as follows:

The purpose of this measure is to require licensure of persons offering occupational therapy services.

Your Committee finds that occupational therapists are currently regulated under a "title protection" form, which is not as restrictive as what is being proposed by this measure. Persons concerned about protection of frail, vulnerable patients feel that licensure is the best way to protect the consumer and assure competence of the practitioner of occupational therapy, because of expectations of education, experience, and examination required of a licensed individual. As such, this measure can be expected to raise consumer expectations of occupational therapists.

Your Committee has amended this measure by:

(1) Having the licensing requirements take effect on July 1, 2020 to make the bill defective in order to promote continuing discussion; and

(2) Renumbering the items in the definition of "occupational therapy service" to eliminate the ambiguity of citation caused by having more than one set of identically numbered paragraphs.

As affirmed by the record of votes of the members of your Committee on Ways and Means that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 591, S.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as S.B. No. 591, S.D. 2.
