Sir:
Your Committee on Education, to which was referred S.B. No. 566 entitled:
"A BILL FOR AN ACT RELATING TO EDUCATION,"
begs leave to report as follows:
The purpose of this measure is to require the Department of Education (DOE) to establish a program allowing home schooled students to participate in extracurricular activities offered by the public school in the same district.
Your Committee received testimony in opposition from the DOE.
Your Committee recognizes that home schooling is a popular and viable option for many parents. Your Committee believes that home schooled students need to have a well-balanced education, similar to public schools. However, home schooled students lack the same academic and recreational enrichment provided by extracurricular activities of the public schools. This measure remedies that inequity by giving home schooled students access to extracurricular activities of the public school in the same district.
Your Committee has amended this measure by requiring as a precondition to the student's participation in extracurricular activities:
(1) Proof of having adequate health insurance to cover injuries;
(2) A signed waiver of liability by the parent or guardian;
(3) Payment of a reasonable fee based on cost; and
(4) Passing the previous grade, as determined by standards of the DOE or home schooling.
Your Committee has further amended this measure by requiring the DOE to adopt rules to implement this measure, and made technical, nonsubstantive amendments to comport with proper drafting.
As affirmed by the record of votes of the members of your Committee on Education that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 566, as amended herein, and recommends that it pass Second Reading in the form attached hereto as S.B. No. 566, S.D. 1, and be referred to the Committee on Ways and Means.
