Sir:

Your Committee on Ways and Means, to which was referred S.B. No. 535, S.D. 1, entitled:

"A BILL FOR AN ACT RELATING TO EDUCATION,"

begs leave to report as follows:

The purpose of this measure is to require the Department of Education to adopt a risk management and related programs for school administrators, teachers, and other school personnel.

Additionally, this measure appropriates funds to the Department of Education to establish the programs.

Your Committee finds that the Department of Education needs to have in place a risk management program in order to mitigate the risks of lawsuits and the potential for job performance liability. Your Committee finds that departmental employees are already experiencing litigation in the performance of their duties and are not fully aware of the risks incumbent in their workplace decisions and actions.

Your Committee has amended this measure by changing the appropriation amount to a blank amount and by making technical nonsubstantive amendments for the purposes of clarity and style.

As affirmed by the record of votes of the members of your Committee on Ways and Means that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 535, S.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as S.B. No. 535, S.D. 2.
