Sir:

Your Committee on Judiciary, to which was referred S.B. No. 495, S.D. 1, entitled:

"A BILL FOR AN ACT RELATING TO HALFWAY HOUSES,"

begs leave to report as follows:

The purpose of this measure is to define halfway houses for the purposes of applicable county zoning permits.

Your Committee received testimony in support of this measure from the Department of Public Safety and T. J. Mahoney & Associates. Hale `Opio Kaua`i, Inc., submitted testimony in opposition.

Your Committee finds that there are still community concerns regarding halfway houses that should be addressed in order to ensure that all parties have a full understanding of the proposed facility.

Your Committee has amended this measure accordingly to require the appropriate county agency to conduct a public hearing in the affected community before granting any permit.

As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 495, S.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as S.B. No. 495, S.D. 2.
