STAND. COM. REP. NO. 162

Honolulu, Hawaii

, 2001

RE: S.B. No. 460

S.D. 1

Honorable Robert Bunda

President of the Senate

Twenty-First State Legislature

Regular Session of 2001

State of Hawaii

Sir:

Your Committees on Agriculture and Water, Land, Energy and Environment, to which was referred S.B. No. 460 entitled:

"A BILL FOR AN ACT RELATING TO THE STATE WATER CODE,"

beg leave to report as follows:

The purpose of this measure is to appropriate funds for the implementation of the Agricultural Water Use and Development Plan.

Your Committees received testimony in favor of this measure from the Department of Agriculture (DOA), Department of Land and Natural Resources, Department of Water of Kauai County, Hawaii Farm Bureau Federation, Maui County Farm Bureau, Big Island Farm Bureau, and Hawaii Agriculture Research Center.

Your Committees find that section 174C-31(c), Hawaii Revised Statutes, requires the DOA to prepare a comprehensive agricultural water use and development plan including a master irrigation inventory plan for agriculture uses in the State. However, no funds have been provided for the Department of Agriculture for this purpose. The appropriation provided by this measure will allow the DOA to develop and implement the plan.

Your Committees have amended this measure by:

(1) Inserting the estimated cost of $750,000 as the appropriation amount; and

(2) Providing that the plan is deemed necessary to qualify for federal aid financing and reimbursement pursuant to Public Law 106-566.

As affirmed by the records of votes of the members of your Committees on Agriculture and Water, Land, Energy and Environment that are attached to this report, your Committees are in accord with the intent and purpose of S.B. No. 460, as amended herein, and recommend that it pass Second Reading in the form attached hereto as S.B. No. 460, S.D. 1, and be referred to the Committee on Ways and Means.

Respectfully submitted on behalf of the members of the Committees on Agriculture and Water, Land, Energy and Environment,
