Sir:

Your Committee on Judiciary, to which was referred S.B. No. 233, S.D. 1, entitled:

"A BILL FOR AN ACT RELATING TO CHIROPRACTIC,"

begs leave to report as follows:

The purpose of this measure is to clarify the scope of practice of chiropractic.

Your Committee received testimony in support of this measure from the Board of Chiropractic Examiners, Hawaii State Chiropractic Association, Massage Therapists Association, Hilo Accident & Industrial Injury Clinic, Hilo Chiropractic Clinic, Young Chiropractic Center, Klein Chiropractic Center, Hawai'i Nurses' Association, American Physical Therapy Association Hawaii Chapter, Waipahu Chiropractic Clinic, Pukalani Chiropractic, Hawaii Physical Therapy & Chiropractic Clinic, Inc., Back In Action Chiropractic, Three Treasures Oriental Medicine, and seven private citizens. Testimony in opposition was received from the Hawaii Medical Association and Hawaii Insurers Council.

Your Committee believes that the clarifying amendments in this measure are warranted and will not harm the public health or safety.

Your Committee has retained the effective date of July 1, 2050 in the interests of keeping this measure alive and to ensure that this measure is revisited in this legislative session. Your Committee has also corrected a typographical error and clarified the use of the term "chiropractic".

As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 233, S.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as S.B. No. 233, S.D. 2.
