Sir:
Your Committee on Judiciary, to which was referred S.B. No. 187 entitled:
"A BILL FOR AN ACT RELATING TO COURTS,"
begs leave to report as follows:
The purpose of this measure is to make an appropriation to expand the drug court system for adults and juveniles for the second circuit on Maui, including related drug and rehabilitation programs in rural areas of the Islands of Maui, Lanai, and Molokai.
Your Committee received testimony in support of this measure from the Judiciary, Department of Public Safety, Hawaii Paroling Authority, Circuit Court of the Second Circuit, Office of the Mayor of Maui, Honolulu Prosecuting Attorney, Maui Housing and Human Concerns Department, Kako'o 'Ohana Pa'ahao, Community Alliance on Prisons, Friends of the Maui Drug Court, a Maui Council Member, and a private citizen.
The drug court is an administrative initiative of the Judiciary. The drug court has proven to be an effective and economical means of diverting drug offenders into a specialized system of treatment. Drug courts dovetail nicely with the Governor's proposal to divert nonviolent drug offenders into treatment programs.
Your Committee has amended this measure by inserting a statutory enactment to permanently establish a drug court in the second circuit.
As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 187, as amended herein, and recommends that it pass Second Reading in the form attached hereto as S.B. No. 187, S.D. 1, and be referred to the Committee on Ways and Means.
