Sir:

Your Committee on Ways and Means, to which was referred S.B. No. 181, S.D. 2, entitled:

"A BILL FOR AN ACT RELATING TO TOBACCO PRODUCTS,"

begs leave to report as follows:

The purpose of this measure is to establish a statewide tobacco licensing program under the jurisdiction of the Department of Health.

Specifically, this bill:

(1) Establishes classes of tobacco dealer;

(2) Provides for the application for tobacco licenses;

(3) Imposes certain prohibitions on licensees and sets penalties and fines;

(4) Regulates import of tobacco;

(5) Provides for fees and restricts use of fees collected;

(6) Authorizes right of inspection and entry for examination;

(7) Authorizes the Department to adopt rules; and

(8) Establishes an affirmative defense to a charge of selling tobacco to a minor that the minor had a false photo identification that closely resembled an authentic photo identification.

Upon further consideration, your Committee has amended this bill by changing the effective date to July 1, 2050 for the purpose of making the bill defective in order to promote continuing discussion. Your Committee has also made several technical nonsubstantive amendments for the purpose of clarity and style, including changing the incorrect reference to section 328K-7, Hawaii Revised Statutes, to section 328K-21, Hawaii Revised Statutes at the end of section   -4.

As affirmed by the record of votes of the members of your Committee on Ways and Means that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 181, S.D. 2, as amended herein, and recommends that it pass Third Reading in the form attached hereto as S.B. No. 181, S.D. 3.
