Sir:

Your Committee on Transportation, Military Affairs and Government Operations, to which was referred S.B. No. 1603 entitled:

"A BILL FOR AN ACT RELATING TO ALCOHOL, DRUGS, AND HIGHWAY SAFETY,"

begs leave to report as follows:

The purpose of this measure is to require a health care provider to report to any law enforcement officer after a motor vehicle collision if the driver's blood or urine results contain one or more drugs that could impair the ability to drive.

Your Committee received testimony in support of this measure from the Department of Transportation, Honolulu Police Department, and Honolulu Prosecuting Attorney.

If an impaired driver has been involved in a collision and the health care provider, who usually conducts a blood or urine test after the collision, has evidence of impairment, it should be incumbent upon the provider to report it to law enforcement authorities as is done for alcohol content. Your Committee finds that impaired driving due to drug consumption is increasing. This measure will keep up with changing times in the interest of protecting the health and safety of motorists.

Your Committee has amended this measure to make technical, nonsubstantive amendments for proper drafting.

As affirmed by the record of votes of the members of your Committee on Transportation, Military Affairs and Government Operations that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1603, as amended herein, and recommends that it pass Second Reading in the form attached hereto as S.B. No. 1603, S.D. 1, and be referred to the Committee on Judiciary.
