Your Committee on Judiciary, to which was referred S.B. No. 1600, S.D. 1, entitled:

"A BILL FOR AN ACT RELATING TO ALCOHOL, DRUGS, AND HIGHWAY SAFETY,"

begs leave to report as follows:

The purpose of this measure is to authorize police officers to determine the method of testing persons stopped for driving under the influence.

Your Committee received testimony in favor of this measure from Mothers Against Drunk Driving and the Honolulu Prosecuting Attorney. Your Committee received testimony opposing this measure from the Public Defender.

Your Committee finds that certain drug substances, such as inhalants, are more accurately detected in the blood rather than in urine. Other substances may be more easily detected in urine than in blood. If the officer believes the person is under the influence of a particular substance, the officer can select the test best suited to detect the substance.

As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1600, S.D. 1, and recommends that it pass Third Reading.
