Sir:

Your Committee on Judiciary, to which was referred S.B. No. 1556 entitled:

"A BILL FOR AN ACT RELATING TO ACT 278, SESSION LAWS OF HAWAII 1999,"

begs leave to report as follows:

The purpose of this measure is to clarify the reenactment provisions of 1999 amendments to the crime victim compensation special fund (fund).

Your Committee received testimony in support of this measure from the Crime Victim Compensation Commission and Honolulu Prosecuting Attorney. The Legislative Reference Bureau submitted information.

Act 278, Session Laws of Hawaii (SLH) 1999, amended, among other things, the requirements of usage of moneys in the fund to allow the payment of salaries and collection of fees. These amendments will sunset on July 1, 2001. However, Act 115, SLH 2000, also made amendments to the same statutory section, which necessitates this measure to clear up the confusion on what would happen on the repeal date. This measure clarifies that on July 1, 2001, the section would be reenacted without the 1999 amendments and the amendments contained in Act 115, SLH 2000, would not be repealed.

As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1556 and recommends that it pass Second Reading and be referred to the Committee on Ways and Means.
