Sir:
Your Committee on Judiciary, to which was referred S.B. No. 1515 entitled:
"A BILL FOR AN ACT RELATING TO SENTENCING,"
begs leave to report as follows:
The purpose of this measure is to clarify the sentencing laws. Specifically, this measure would:
(1) Add the offense of unauthorized entry into a motor vehicle as one of the offenses subject to mandatory minimum term of imprisonment;
(2) Require the filing of a restitution order against a minor in the circuit court;
(3) Add attempted murder to the list of offenses subject to a mandatory minimum term of imprisonment for offenses against children, elder persons, and handicapped persons; and
(4) Disallow deferred acceptance of guilty pleas for any felony that involves substantial bodily injury.
Your Committee received testimony in support of this measure from the Honolulu Prosecuting Attorney and Honolulu Police Department. The Judiciary submitted comments.
Your Committee has amended this measure on the recommendation of the Judiciary that for the issuance of restitution orders against juveniles, amending section 571-48, Hawaii Revised Statutes (HRS), relating to adjudication of juvenile offenders would be more appropriate than amending section 706-647, HRS, which relates to convicted defendants.
As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1515, as amended herein, and recommends that it pass Second Reading in the form attached hereto as S.B. No. 1515, S.D. 1, and be placed on the calendar for Third Reading.
