Sir:

Your Committee on Judiciary, to which was referred S.B. No. 1458 entitled:

"A BILL FOR AN ACT RELATING TO JURORS,"

begs leave to report as follows:

The purpose of this measure is to require that jurors be paid $40 for each day of actual attendance at court plus 37 cents per mile of travel to and from court.

Your Committee received testimony in support of this measure from the Judiciary.

Current law provides for payment of 33 cents per mile, enacted by Act 189 Session Laws of Hawaii (SLH) 1988, and of $30 per day, enacted by Act 251, SLH 1986. Your Committee finds that these amounts are inadequate, and could cause potential jurors to balk at performing a public service. This measure is intended to bring payment of jurors closer to minimum wage standards for an eight hour day.

Your Committee notes testimony of the Judiciary that $40 per day is the amount paid jurors in federal court.

As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1458 and recommends that it pass Second Reading and be referred to the Committee on Ways and Means.
