Your Committee on Judiciary, to which was referred S.B. No. 1452 entitled:
"A BILL FOR AN ACT RELATING TO LAND COURT,"
begs leave to report as follows:
The purpose of this measure is to clarify provisions in various sections of chapter 501, Hawaii Revised Statutes, to facilitate the land court recording process.
Your Committee received testimony in favor of this measure from the Judiciary and the Department of Land and Natural Resources.
Your Committee finds that certain inefficiencies and non-conforming provisions in the laws relating to land court recordation have been identified. This measure improves efficiency by allowing discreet nonsubstantive alterations to documents to be recorded and speeding up the probate process relating to the proper distribution of registered land or estate of a decedent. In addition, this measure conforms the size of documents to the size requirements provided in the Rules of the Land Court and section 502-31, Hawaii Revised Statutes.
Your Committee has amended this measure by clarifying that if the certificate reference in an instrument is incorrect or absent, an endorsement of the current certificate of title shall be required.
As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1452, as amended herein, and recommends that it pass Second Reading in the form attached hereto as S.B. No. 1452, S.D. 1, and be placed on the calendar for Third Reading.
