Your Committee on Health and Human Services, to which was referred S.B. No. 138 entitled:

"A BILL FOR AN ACT RELATING TO CAREGIVERS,"

begs leave to report as follows:

The purpose of this measure is to allow a caregiver to consent on behalf of a minor to enrollment in school and school-related medical care.

Your Committee received testimony commenting on this measure from the Department of Education.

Your Committee finds that in certain situations, it is appropriate for caregivers to have the capacity to consent on behalf of the minor in their care. Regardless, child safety remains paramount and additional discussion is needed to ensure that it is not compromised. Thus, your Committee has amended this measure by providing a defective effective date to further discussion on the matter.

As affirmed by the record of votes of the members of your Committee on Health and Human Services that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 138, as amended herein, and recommends that it pass Second Reading in the form attached hereto as S.B. No. 138, S.D. 1, and be referred to the Committee on Judiciary.
