Sir:
Your Committee on Ways and Means, to which was referred S.B. No. 1182, S.D. 1, entitled:
"A BILL FOR AN ACT RELATING TO CONTROLLED SUBSTANCES,"
begs leave to report as follows:
The purpose of this measure is to make various amendments to the medical marijuana law.
Specifically, this measure:
(1) Authorizes money from the controlled substance registration revolving fund to be used to issue patient registry identification certificates;
(2) Deposits fees for the registry certificates into the revolving fund;
(3) Defines the "registry identification certificate";
(4) Eliminates the Department of Health's authority to recognize instances of debilitating medical conditions other than those statutorily recognized;
(5) Disqualifies a person with a prior conviction under the federal and state controlled substance laws from being a primary caregiver;
(6) Requires a physician's written certification to be based on a full assessment of the patient's medical history and current medical condition;
(7) Specifies the locations at which the marijuana for medical uses may be grown;
(8) Eliminates certain activities from the scope of the exemption; and
(9) Requires the Department of Health to disclose the registry list to the county police.
Your Committee has amended this measure by changing the effective date to July 1, 2005, to continue discussion on the measure and by making technical nonsubstantive amendments for the purposes of clarity and style.
As affirmed by the record of votes of the members of your Committee on Ways and Means that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1182, S.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as S.B. No. 1182, S.D. 2.
