Your Committees on Judiciary and Health and Human Services, to which was referred S.B. No. 1177 entitled:

"A BILL FOR AN ACT RELATING TO CORRECTIONAL HEALTH CARE,"

beg leave to report as follows:

The purpose of this measure is to establish a correctional health care program within the Department of Public Safety.

Your Committees received testimony in support of this measure from the Department of Public Safety and Hawaii Government Employees Association.

This measure formalizes into statute what exists by current practice. However, physicians are usually hired as private contractors presently. Your Committees believe that they, as well as the administrator of the program, should be made state employees.

Your Committees have amended this measure to clarify that any physician working as a civil service employee at the time of the effective date of this measure will have the option of continuing in civil service or becoming an exempt employee.

As affirmed by the records of votes of the members of your Committees on Judiciary and Health and Human Services that are attached to this report, your Committees are in accord with the intent and purpose of S.B. No. 1177, as amended herein, and recommend that it pass Second Reading in the form attached hereto as S.B. No. 1177, S.D. 1, and be referred to the Committee on Ways and Means.
