Sir:
Your Committee on Health and Human Services, to which was referred S.B. No. 1175 entitled:
"A BILL FOR AN ACT RELATING TO THE SALE OF POISONS,"
begs leave to report as follows:
The purpose of this measure is to clarify the definition of a "poison" and remove the mandate for the Department of Health to adopt rules and regulations to regulate the sale of poison.
Testimony in support of this measure was submitted by the Department of Health and the Office of the Lieutenant Governor.
Your Committee finds that when chapter 330, Hawaii Revised Statutes, was enacted more that a century ago, laws to regulate poisons were virtually non-existent. Today, poisons are effectively regulated under federal and state laws enforced by the U.S. Environmental Protection Agency, the U.S. Food and Drug Administration, the U.S. Consumer Product Safety Commission, and the Pesticides Branch of the State Department of Agriculture. Thus, your Committee believes that this measure helps Hawaii slice waste and red tape by not requiring the rules and regulations, but making them optional.
As affirmed by the record of votes of the members of your Committee on Health and Human Services that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1175 and recommends that it pass Second Reading and be placed on the calendar for Third Reading.
