Sir:
Your Committee on Economic Development and Technology, to which was referred S.B. No. 1170, S.D. 1, entitled:
"A BILL FOR AN ACT RELATING TO DISPLACED LESSEES,"
begs leave to report as follows:
The purpose of this measure is to provide that lessees displaced from property already owned by the State or any county also qualify for a preference granting such lessees the right of first refusal for a lease at an eligible relocation site, and clarifies that the relocation sites must be in an existing or designated industrial park site.
Your Committee received testimony in favor of this measure from the Board of Land and Natural Resources, Department of Transportation, Hawaii Community Development Authority, and Board of Agriculture. Your Committee received testimony opposing this measure from Taylor Consultants, Chamber of Commerce of Hawaii, and Clean-N-Rooter.
Your Committee finds that the Produce Center, under a 55-year State lease expiring in 2029, is currently located on the grounds of the proposed site for the University of Hawaii Medical School at Kakaako. The Hawaii Community Development Authority seeks to relocate the Produce Center out of Kakaako to allow for the development of the medical school. The Produce Center is the primary supplier of fresh produce in the State, and must be located near a sea port since much of its stock is shipped in refrigerated containers, which therefore makes Kapalama a prime site for relocation.
Your Committee further finds that the businesses currently leasing space at Kapalama are under month-to-month leases and that these small businesses will have their leases terminated by this measure.
Your Committee has amended this measure by:
(1) Addressing the need for greater coordination, planning, communication, and community involvement in the relocation process for the success of the affected Kapalama businesses as well as the Kakaako redevelopment projects;
(2) Providing the reason for displacement, which is the proposed development of the University of Hawaii Medical School; that the state administrative liaison for relocation shall be the governor's chief of staff or the executive director of Hawaii Community Development Corporation; and that the development and approval of the relocation plan shall involve all affected parties;
(3) Stating that the community desires other proposed projects within Kakaako; and
(4) Defecting the effective date as a means of channeling the measure to conference.
As affirmed by the record of votes of the members of your Committee on Economic Development and Technology that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1170, S.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as S.B. No. 1170, S.D. 2.
