Your Committee on Judiciary, to which was referred S.B. No. 1166 entitled:
"A BILL FOR AN ACT RELATING TO PENALTIES FOR THE STATEWIDE TRAIL AND ACCESS PROGRAM,"
begs leave to report as follows:
The purpose of this measure is to establish administrative and criminal penalties for violations of statutory provisions on rules relating to the statewide trails and access program.
Your Committee received testimony in favor of this measure from Annette's Adventures, the Board of Land and Natural Resources, and the Hawaii Tourism Authority.
Your Committee finds that there is a problem with some tour operators violating the State's trail and access program. One of the primary reasons such abuse continues to exist is a result of the lack of penalties. The establishment of administrative and criminal penalties is an appropriate way to deter illegal activities relating to the statewide trails and access program.
As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1166 and recommends that it pass Third Reading.
