Your Committees on Water, Land, Energy and Environment and Commerce, Consumer Protection and Housing, to which was referred S.B. No. 1136 entitled:
"A BILL FOR AN ACT RELATING TO USED OIL,"
beg leave to report as follows:
The purpose of this measure is to establish a used oil collection and recycling program.
Your Committees received testimony in support of this measure from the Department of Health. The Hawaii Motorcycle Dealers Association submitted testimony in opposition. Hawaiian Electric Company, Inc., submitted comments.
Your Committees find that an estimated six million gallons of lubricating oil enter the State each year. Annual reports from permitted used oil processors indicate that approximately three million gallons of used oil were properly disposed of in the year 2000. The State has been unable to track disposal of the rest, but believes much of it may have been dumped on the ground, and in trash containers and storm drains.
Your Committees are concerned about the impact such dumping may have on the environment and human health and support this measure's efforts to track and recycle used oil. Your Committees have amended this measure to exempt from the fee requirements those oil importers who reuse or recycle oil on site, or who import less than five hundred gallons per quarter, and made technical, nonsubstantive amendments.
As affirmed by the records of votes of the members of your Committees on Water, Land, Energy and Environment and Commerce, Consumer Protection and Housing that are attached to this report, your Committees are in accord with the intent and purpose of S.B. No. 1136, as amended herein, and recommend that it pass Second Reading in the form attached hereto as S.B. No. 1136, S.D. 1, and be referred to the Committee on Ways and Means.
