Sir:
Your Committee on Judiciary, to which was referred S.B. No. 1131, S.D. 1, entitled:
"A BILL FOR AN ACT RELATING TO SPECIAL WASTES RECYCLING,"
begs leave to report as follows:
The purposes of this measure are to:
(1) Allow the Department of Health to take administrative action against violators of the law relating to lead acid batteries;
(2) Allow tire retailers to list a separate disposal fee as part of the final price of a new tire; and
(3) Define a limit at which the tire retailer will be required to obtain a permit as a used tire collection facility.
Testimony in support of this measure was submitted by the Department of Health, Department of Commerce and Consumer Affairs, University of Hawaii Environmental Center, and the Legislative Committee for Catrala-Hawaii.
Your Committee finds that current law requires the State to enter civil court proceedings to enforce lead acid battery law violations. Your Committee further finds that tire retailers should be provided the flexibility to list the cost of tire disposal as a separate charge that is not refundable or negotiable. This measure will allow administrative collection of penalties and will prevent ambiguity as to what the tire disposal fee should and should not be.
Your Committee has amended this measure to allow for tire inventory payment to be on an annual basis for the car rental industry rather than quarterly.
As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1131, S.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as S.B. No. 1131, S.D. 2.
