Sir:

Your Committee on Judiciary, to which was referred S.B. No. 1126 entitled:

"A BILL FOR AN ACT RELATING TO CRIMINAL HISTORY,"

begs leave to report as follows:

The purpose of this measure is to make permanent the requirement that the Department of Health (DOH) obtain criminal history record checks on persons in positions having direct contact with clients receiving mental health services in the child and adolescent mental health division.

Your Committee received testimony in support of this measure from the Attorney General, DOH, Hawaii Youth Services Network, and Hale 'Opio Kaua'i, Inc.

Act 146, Session Laws of Hawaii 2000, required criminal history record checks on persons in positions, whether as employees of the DOH or as private contractors, that require them to have private, personal contact with clients in the child and mental health division. This measure repeals the sunset date of June 30, 2001.

This measure is mainly intended for the background checks on the Felix consent decree providers.

Your Committee has amended this measure by making technical, nonsubstantive amendments for proper drafting.

As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1126, as amended herein, and recommends that it pass Second Reading in the form attached hereto as S.B. No. 1126, S.D. 1, and be referred to the Committee on Ways and Means.
