Sir:

Your Committee on Judiciary, to which was referred S.B. No. 1109 entitled:

"A BILL FOR AN ACT RELATING TO MEDICAL ASSISTANCE RECOVERY,"

begs leave to report as follows:

The purpose of this measure is to assure that the State is notified of all claims it may have against a third person for medical assistance and burial expenses.

Testimony is support of this measure was submitted by the Department of Human Services.

Your Committee finds that this measure will ensure that the State is given notice of all potential third party claims under the Medical Assistance Program. This will expand the State's avenues of recovery in cases where third party recovery is made without notice to the State and allow the recovery of third party reimbursements without additional expenses.

As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1109 and recommends that it pass Third Reading.
