Your Committee on Health and Human Services, to which was referred S.B. No. 1107 entitled:

"A BILL FOR AN ACT RELATING TO HUMAN SERVICES,"

begs leave to report as follows:

The purpose of this measure is to establish licensing requirements and standards for home and community-based case management agencies which are responsible for providing services to individuals in and issuing certificates of approval to community care foster family homes.

Your Committee received testimony in favor of this measure from the Department of the Attorney General, Department of Human Services, Case Management, Inc., ABEL Case Management, Inc., Queen's Medical Center, Catholic Charities Elderly Services, Coalition for Affordable Long Term Care, Kokua Council, Residential Choices, Inc., Hale Makua, and three individuals. One person submitted comments on this measure.

Your Committee finds that community care foster family homes are becoming a more viable option for individuals who are in need of intermediate or skilled nursing services. Patient care at these homes, including registered nurse services and social work intervention, is carefully and regularly monitored by a case management agency. However, current law limits acceptance into a community care foster family program to qualified Medicaid recipients. Your Committee finds that this measure will establish consistent and uniform guidelines for these homes that will allow for the acceptance of private pay individuals.

Your Committee has amended this measure by:

(1) Specifying, for purposes of a criminal history check, that a fingerprint search be conducted within the Federal Bureau of Investigation's criminal history record files; and

(2) Making technical, nonsubstantive amendments to reflect proper drafting style.

As affirmed by the record of votes of the members of your Committee on Health and Human Services that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1107, as amended herein, and recommends that it pass Second Reading in the form attached hereto as S.B. No. 1107, S.D. 1, and be referred to the Committee on Ways and Means.
