Sir:

Your Committee on Health and Human Services, to which was referred S.B. No. 1105 entitled:

"A BILL FOR AN ACT RELATING TO INFORMATION ON THE NATURAL PARENTS OF THE ADOPTED MINOR CHILD,"

begs leave to report as follows:

The purpose of this measure is to expedite the adoption process when it is in the best interest of the child by exempting the Department of Human Services from the requirements of preparing a "medical information form" pursuant to section 578-14.5, Hawaii Revised Statutes.

Your Committee received testimony in favor of this measure from the Department of Human Services.

Your Committee finds that this measure makes the process of adoption more efficient while ensuring that the best interests of the child are met.

Your Committee agrees with the amendments recommended by the Department of Human Services and has amended this measure by:

(1) Requiring a court, when considering the disposition of a child under the state Child Protective Act, to order the natural parents of the child to complete and provide to the Department of Human Services a medical information form pursuant to section 578-14.5, Hawaii Revised Statutes; and

(2) Replacing the current exemption provided by this measure to the Department of Human Services with provisions that waive the requirement that the medical information of the natural parents accompany any document filed with family court pursuant to section 578-14.5, Hawaii Revised Statutes, if the parents fail to comply with a court order to fill out a medical information form pursuant to section 587-71(n), Hawaii Revised Statutes.

Your Committee finds that these amendments mandate parents to provide the necessary medical information and also allow the department to proceed with the adoption process without delay if the parents fail to provide this information.

As affirmed by the record of votes of the members of your Committee on Health and Human Services that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1105, as amended herein, and recommends that it pass Second Reading in the form attached hereto as S.B. No. 1105, S.D. 1, and be referred to the Committee on Judiciary.
