Your Committee on Judiciary, to which was referred S.B. No. 1077, S.D. 1, entitled:

"A BILL FOR AN ACT RELATING TO TRADEMARKS,"

begs leave to report as follows:

The purpose of this measure is to conform Hawaii's trademark law to the most recent version of the Model State Trademark Bill by updating registration provisions for trademarks and service marks.

Your Committee heard testimony in support of the measure from the State Commissioner of Securities.

Your Committee finds that this measure allows for greater damage awards to injured trademark holders, includes a comprehensive definition section, and addresses issues and situations that are not addressed by the current law. These new provisions would protect the rights of trademark holders in Hawaii much more clearly and comprehensively than the current law does. By adopting model language that is uniform with a majority of the states, and by incorporating the latest developments in business registration law, this measure would support the freer flow of commerce, the development of the State's economy, and improve Hawaii's business climate.

As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1077, S.D. 1, and recommends that it pass Third Reading.
