Sir:
Your Committee on Ways and Means, to which was referred H.B. No. 728, S.D. 1, entitled:
"A BILL FOR AN ACT RELATING TO INCREASING DEVELOPMENT FLEXIBILITY OF PUBLIC LANDS,"
begs leave to report as follows:
The purpose of this measure is to give the Department of Transportation's Airports Division greater flexibility in the disposition of leases and development procedures, subject to the approval of the Board of Land and Natural Resources.
Specifically, the bill:
(1) Allows the disposition of public lands for airport related operations to be negotiated in the same manner as the disposition of public lands for airline and aircraft operations;
(2) Defines "airport related"; and
(3) Provides that structures and land improvements used for airport purposes:
(A) May be planned, designed, and constructed without approval of county agencies; and
(B) Shall be exempt from county special management areas permitting requirement.
Your Committee finds that current procedures have hindered the Airports Division of the Department of Transportation in the development of its lands and facilities. This measure gives the Airports Division flexibility in "non-aeronautical" uses of lands and facilities by providing that public lands for "airport related" operations may be disposed in the same manner as public lands for airline and aircraft operations. The addition of "airport related activities" will allow for long term leases not previously available for activities considered non-aeronautical, providing a positive impact on the State's economy.
As affirmed by the record of votes of the members of your Committee on Ways and Means that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 728, S.D. 1, and recommends that it pass Third Reading.
