Your Committee on Health and Human Services, to which was referred H.B. No. 703, H.D. 1, entitled:

"A BILL FOR AN ACT RELATING TO CONTROLLED SUBSTANCES,"

begs leave to report as follows:

The purpose of this measure is to revise the statutory listing of controlled substances.

Your Committee heard testimony in support of the measure from the Department of Public Safety, Office of the Public Defender, and Orphan Medical.

Your Committee finds that revising the statutory listing of controlled substances will give law enforcement authorities important tools to stay ahead of the ever-changing drug trends.

Your Committee has amended this measure by replacing its contents with the contents of S.B. No. 1178, S.D. 2, which are substantially similar except for technical differences, and adding provisions criminalizing controlled substance analogues and authorizing the Department of Public Safety to change the schedule of controlled substances by rulemaking without legislative approval.

As affirmed by the record of votes of the members of your Committee on Health and Human Services that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 703, H.D. 1, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 703, H.D. 1, S.D. 1, and be referred to the Committee on Judiciary.
