Your Committees on Health and Human Services and Judiciary, to which was referred H.B. No. 702, H.D. 2, entitled:

"A BILL FOR AN ACT RELATING TO CORRECTIONAL HEALTH CARE,"

beg leave to report as follows:

The purpose of this measure is to establish a correctional health care program within the Department of Public Safety (PSD).

Your Committees received testimony in support of this measure from the PSD and Hawaii Government Employees Association.

This measure formalizes into statute what exists by current practice. However, physicians are usually hired as private contractors. Your Committees believe that they, as well as the administrator of the program, should be exempt from civil service. Your Committees amended this measure to delete the provision giving physicians sixty days from the effective date of the Act to exercise the option of becoming an exempt employee.

As affirmed by the records of votes of the members of your Committees on Health and Human Services and Judiciary that are attached to this report, your Committees are in accord with the intent and purpose of H.B. No. 702, H.D. 2, as amended herein, and recommend that it pass Second Reading in the form attached hereto as H.B. No. 702, H.D. 2, S.D. 1, and be referred to the Committee on Ways and Means.
