Sir:

Your Committee on Judiciary, to which was referred H.B. No. 699 entitled:

"A BILL FOR AN ACT RELATING TO SUBSTANCE ABUSE TESTING,"

begs leave to report as follows:

The purpose of this measure is to eliminate unnecessary paperwork by deleting the requirement that individuals who are to be tested for substance abuse be given a "medical disclosure form" to permit the individual to disclose the medication taken within the previous thirty days.

Your Committee received written testimony in support of this measure from the Office of the Lieutenant Governor and the Department of Health, noting that the disclosure form is unnecessary since this type of information will be solicited if a test result is positive and may violate the privacy of individuals undergoing testing.

Your Committee finds that this measure improves government efficiency without jeopardizing the health, safety, or welfare of the public.

As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 699 and recommends that it pass Third Reading.
