Sir:
Your Committee on Ways and Means, to which was referred H.B. No. 695, H.D. 1, S.D. 1, entitled:
"A BILL FOR AN ACT RELATING TO DISPLACED LESSEES,"
begs leave to report as follows:
The purpose of this measure is to provide that lessees displaced from property already owned by the State or any county also qualify for a preference granting those lessees the right of first refusal for a lease at an eligible relocation site.
The bill also clarifies that the relocation sites must be in an existing or designated industrial park site.
Your Committee notes that proposed efforts to redevelop the Kakaako waterfront area will require greater planning and coordination in the relocation process to assist potentially displaced lessees. Your Committee recognizes that some of the lessees may be confused with their relocation and your Committee raised concerns that the administration needs to provide better communication to the lessees to prevent further confusion.
Your Committee notes that the S.D. 1 version of this bill replaced its contents with that of S.B. No. 1170, S.D. 1. Upon further consideration, your Committee has amended this measure by replacing its contents with those of S.B. No. 1170, S.D. 2, which amended the S.D. 1 version of that bill by:
(1) Addressing the need for greater coordination, planning, communication, and community involvement in the relocation process for the success of the affected Kapalama businesses as well as the Kakaako redevelopment projects;
(2) Providing the reason for displacement, which is the proposed development of the University of Hawaii Medical School; that the state administrative liaison for relocation shall be the governor's chief of staff or the executive director of Hawaii Community Development Corporation; and that the development and approval of the relocation plan shall involve all affected parties;
(3) Stating that the community desires other proposed projects within Kakaako; and
(4) Changing the effective date to July 1, 2050 to promote continuing discussion.
As affirmed by the record of votes of the members of your Committee on Ways and Means that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 695, H.D. 1, S.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as H.B. No. 695, H.D. 1, S.D. 2.
