RE: H.B. No. 634
Honorable Robert Bunda
President of the Senate
Twenty-First State Legislature
Regular Session of 2001
State of Hawaii
Sir:
Your Committee on Judiciary, to which was referred H.B. No. 634 entitled:
"A BILL FOR AN ACT RELATING TO MEDICAL ASSISTANCE RECOVERY,"
begs leave to report as follows:
The purpose of this measure is to assure that the State is given notice of all potential third party claims and to expand its avenues of recoveries in those cases where third party recoveries are made without notice to the State.
Written testimony in support of this measure was submitted by the Department of Human Services.
Your Committee finds that this measure will assure that the State is given notice of all potential third party claims under The Medical Assistance Program and expand the State's avenues of recoveries in cases where third party recoveries are made without notice to the State. Your Committee further finds that this measure will strengthen the ability of the State to recover third party reimbursements without additional financial expenditures.
As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 634 and recommends that it pass Third Reading.
Respectfully submitted on behalf of the members of the Committee on Judiciary,
