Your Committee on Education, to which was referred H.B. No. 608, H.D. 1, entitled:

"A BILL FOR AN ACT MAKING AN EMERGENCY APPROPRIATION FOR EDUCATION,"

begs leave to report as follows:

The purpose of this measure is to authorize an emergency appropriation for fiscal year 2000-2001 for Felix Consent Decree requirements and authorize transfer of EDN 100 funds for FY 2001.

Your Committee heard testimony in support of the measure from the Department of Education and Attorney General.

Your Committee finds that this measure is necessary to ensure that the State of Hawaii will be in full compliance with the Felix Consent Decree by the December 2001 deadline. Your Committee would note, however, that this is strictly an emergency appropriation for a specified goal of Felix compliance within the specified time frame of fiscal year 2000–2001 and is not intended to establish any type of new funding precedent.

As affirmed by the record of votes of the members of your Committee on Education that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 608, H.D. 1, and recommends that it pass Second Reading and be referred to the Committee on Ways and Means.
