Sir:
Your Committee on Ways and Means, to which was referred H.B. No. 533, H.D. 2, entitled:
"A BILL FOR AN ACT RELATING TO ANTITRUST,"
begs leave to report as follows:
The purpose of this measure is to establish the antitrust trust fund to be administered by the Department of the Attorney General and to be expended for enforcing the antitrust laws.
Furthermore, this measure funds the trust fund through appropriations and ten per cent of antitrust judgments or settlements received by the State. This measure also lapses all unencumbered and unexpended moneys in excess of $250,000 remaining on balance in the fund at the close of the fiscal year to the credit of the general fund.
Additionally, this measure requires the Department of the Attorney General to transfer not more than $150,000 of its fiscal year 2000-2001 general fund appropriation under program identification ATG 100 to the trust fund.
Your Committee finds that establishment of the trust fund to support the enforcement of antitrust laws will provide an economic nexus between the source of the funds and their utilization.
Your Committee has amended this measure by changing the percentage of antitrust judgments and settlements to be deposited into the trust fund from ten per cent to an unspecified percentage. Your Committee has also amended this measure by changing from $150,000 to a blank amount the amount to be transferred from the Attorney General's fiscal year 2000-2001 general fund appropriation to the trust fund.
As affirmed by the record of votes of the members of your Committee on Ways and Means that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 533, H.D. 2, as amended herein, and recommends that it pass Third Reading in the form attached hereto as H.B. No. 533, H.D. 2, S.D. 1.
