Sir:

Your Committee on Judiciary, to which was referred H.B. No. 533, H.D. 2, entitled:

"A BILL FOR AN ACT relating to antitrust,"

begs leave to report as follows:

The purpose of this measure is to establish the antitrust trust fund.

Your Committee received testimony in support of this measure from the Attorney General.

The antitrust trust fund would be under the Department of the Attorney General for the purpose of making expenditures relating to the enforcement of antitrust laws, including such things as training, equipment purchases, educational resources, and facilitating participation in antitrust lawsuits and investigations initiated by other states (in which Hawaii would usually be a party). Funds would come from appropriations and ten per cent of the amount of antitrust judgments and settlements, up to a maximum balance of $250,000, beyond which funds would lapse into the general fund.

Your Committee believes that the antitrust fund would relieve some of the burden on the general fund by allocating moneys received by the State from private parties in antitrust litigation.

As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 533, H.D. 2, and recommends that it pass Second Reading and be referred to the Committee on Commerce, Consumer Protection and Housing.
