Sir:
Your Committees on Judiciary and Ways and Means, to which was referred H.B. No. 524, H.D. 1, entitled:
"A BILL FOR AN ACT RELATING TO COMPUTER CRIME,"
beg leave to report as follows:
The purpose of this measure is to strengthen the State's computer crime laws by:
(1) Replacing current statutes relating to computer crimes with several new offenses and provisions to deter computer fraud, damage, and other computer–related perpetrations;
(2) Allowing the forfeiture of property used in computer crimes;
(3) Setting the statute of limitations for computer-related crimes to within five years after the crime has been committed;
(4) Clarifying the offense of extortion to include threatening by word or conduct to cause damage to a computer, computer system, or computer network;
(5) Updating computer-related definitions to reflect modern technology and for clarity; and
(6) Establishing a temporary advisory commission on computer crimes laws to review the implementation of this measure and determine its effectiveness.
Your Committees received testimony in favor of this measure from the Department of the Prosecuting Attorney of the City and County of Honolulu.
Your Committees find that society is adopting at a rapid pace, computer technology to conduct activities of daily living. Computer technology is being utilized not only for business and recreation purposes, but also for criminal activity. Therefore, computer-related criminal activity is on the rise as society's dependence on computers increases. Your Committees find that this measure modernizes and strengthens the State's computer crimes laws.
As affirmed by the records of votes of the members of your Committees on Judiciary and Ways and Means that are attached to this report, your Committees are in accord with the intent and purpose of H.B. No. 524, H.D. 1, and recommend that it pass Third Reading.
