Sir:

Your Committee on Ways and Means, to which was referred H.B. No. 461 entitled:

"A BILL FOR AN ACT MAKING AN APPROPRIATION FOR THE PARKING PERMIT PROGRAM FOR PERSONS WITH DISABILITIES,"

begs leave to report as follows:

The purpose of this measure is to appropriate funds for the counties to administer the program to issue removable windshield placards for parking to qualified persons with disabilities.

Your Committee finds that the Ninth Circuit Court of Appeals has ruled that public entities may not legally charge persons with disabilities a fee for removable windshield parking placards, and further finds that this ruling leaves the counties with no means to recoup the administrative costs of this valuable service.

Your Committee believes that it is in the interest of the State to have the counties continue administering the parking permit program on behalf of the State, by compensating the counties for this service.

To facilitate further discussion on the funding necessary to carry out the purposes of this measure, your Committee has amended this bill by replacing the blank sum appropriated with the amount of $1, to be divided equally among the counties.

As affirmed by the record of votes of the members of your Committee on Ways and Means that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 461, as amended herein, and recommends that it pass Third Reading in the form attached hereto as H.B. No. 461, S.D. 1.
