Sir:

Your Committee on Judiciary, to which was referred H.B. No. 382, H.D. 1, S.D. 1, entitled:

"A BILL FOR AN ACT RELATING TO PUBLICATiON OF NOTICE,"

begs leave to report as follows:

The purposes of this measure are to allow the finance directors for Hawaii, Kauai, and Maui counties to determine a single publication for county published public notice on each island, and to require the Judiciary, Legislature, and county "vision teams" to provide public notices.

Your Committee received written testimony in support of this measure from the Office of the Mayor of Maui County and from the Chair and three members of the Maui County Council. The Honolulu Department of Planning and Permitting and the Honolulu Advertiser submitted written testimony in opposition to this measure.

Your Committee finds that it can be particularly burdensome for the neighbor islands to publish a statewide notice in every instance. At the same time, your Committee finds that the public interest requires that the neighbor islands give some form of public notice of official actions. Therefore, your Committee supports the primary intent of this measure, to give the counties greater flexibility to determine the most appropriate manner in which to issue public notice.

Your Committee also recognizes that the Legislature, Judiciary, and county "vision teams" also serve important governmental functions and that the public interest may be served by requiring some form of public notice of the activities of those entities as well.

While supporting the general intent of this measure, your Committee has amended this measure by delaying its effective date until January 1, 2050, so that these issues can be further reviewed.

As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 382, H.D. 1, S.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as H.B. No. 382, H.D. 1, S.D. 2.
