Sir:
Your Committee on Health and Human Services, to which was referred H.B. No. 321, H.D. 1, entitled:
"A BILL FOR AN ACT RELATING TO CONTROLLED SUBSTANCES,"
begs leave to report as follows:
The purpose of this measure, as received, is to allow the Department of Public Safety to share with pharmacies prescription information collected utilizing its electronic prescription monitoring system.
Testimony in support of this measure was submitted by the Department of Public Safety (Department). The City and County Department of Human Resources takes no position on this measure but requested the committee to insert two previously heard measures.
Your Committee finds that this measure is a valuable tool for the Department. By allowing it to share controlled substance prescription information with the pharmacist, it will allow the Department to better make informed decisions as to whether or not to fill a questionable prescription for a person that the pharmacist suspects may be attempting to fraudulently obtain a controlled substance.
Your Committee has amended this measure by combining the language of this measure with:
(1) S.B. No. 1182, S.D.2, which revises statutory provisions regulating the use of marijuana for medical purposes, clarifies the definition of "debilitating medical condition", and requires release of names on the registry to county police departments for verification purposes; and
(2) S.B. No. 1231 which amends the definition of "adequate supply" and "written certification"; amends conditions of use; and provides that authorization for use of medical marijuana shall not apply to certain employees or occupations.
As affirmed by the record of votes of the members of your Committee on Health and Human Services that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 321, H.D. 1, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 321, H.D. 1, S.D. 1, and be referred to the Committee on Judiciary.
