Sir:

Your Committee on Agriculture, to which was referred H.B. No. 213, H.D. 2, entitled:

"A BILL FOR AN ACT RELATING TO AGRICULTURE,"

begs leave to report as follows:

The purpose of this measure is to extend the current composition of the agribusiness development corporation's (ADC) board of directors for an additional four years. This measure also makes an appropriation for various agricultural projects.

Your Committee received testimony in favor of this measure from the Hawaii Farm Bureau Federation, Kauai County Farm Bureau, Big Island Farm Bureau, Pioneer Hi-Bred International, Inc., Kauai Economic Development Board, Syngenta, and two individuals.

Your Committee finds that the current composition of the ADC board of directors has been effective and efficient in its duties to service and enhance Hawaii's agriculture industry. By extending this board's term another four years, it will have more time to fully implement its policies. In addition, your Committee finds that an appropriation for various agricultural projects will further advance Hawaii's growing agriculture industry.

Your Committee further finds that the appropriateness of farm dwellings on agricultural land has been a continual challenge to regulate. Definitively authorizing the counties to regulate farm dwellings in class C and lower agricultural lands will help in the development of clear and proper regulations for farm dwellings.

Accordingly, your Committee has amended this measure by:

(1) Specifying that the effective date of the appropriation of this measure shall be July 1, 2001; and

(2) Enabling the counties to define the farm dwellings permitted in lands with soil classified by the land study bureau detailed land classification as overall (master) rating class C or lower; provided that the level of agricultural productivity required to allow such dwellings is established.

As affirmed by the record of votes of the members of your Committee on Agriculture that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 213, H.D. 2, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 213, H.D. 2, S.D. 1, and be referred to the Committee on Ways and Means.
