Your Committee on Tourism and Intergovernmental Affairs, to which was referred H.B. No. 20, H.D. 2, entitled:
"A BILL FOR AN ACT RELATING TO SALES AGENTS OF TIME SHARE UNITS,"
begs leave to report as follows:
The purposes of this measure are to remove the requirement that a time share sales agent register with the director of commerce and consumer affairs, to clarify who must wear a time share identification badge, and to eliminate the requirement that a time share acquisition agent be registered with the department if currently licensed pursuant to Chapter 467, Hawaii Revised Statutes (HRS).
Testimony in support of this measure was received from the Department of Commerce and Consumer Affairs, American Resort Development Association, The Bay Club, Hilton Grand Vacations Club, and Pahio Resorts, Inc.
Your Committee finds that time share sales agents are already licensed as real estate brokers or real estate sales persons under chapter 467, HRS, and this measure would eliminate the current registration duplication. With regards to the identification badge requirement, only acquisition agents who are not licensed real estate brokers will be registered under chapter 514E, HRS, and all other agents will be acting as such. In addition, a time share acquisition agent need not be registered with the department if currently licensed as a real estate broker under chapter 467, HRS.
Your Committee has amended this measure to further clarify the badge requirement language with regards to an acting agent, and to make it clear that the registration exclusion for an acquisition agent applies only to those who are licensed as real estate brokers and does not apply to those who are licensed as real estate salespersons. Your Committee has also reinserted statutory language missing in the hard copy of the bill.
As affirmed by the record of votes of the members of your Committee on Tourism and Intergovernmental Affairs that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 20, H.D. 2, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 20, H.D. 2, S.D. 1, and be referred to the Committee on Commerce, Consumer Protection and Housing.
