Sir:
Your Committee on Tourism and Culture, to which was referred H.B. No. 18 entitled:
"A BILL FOR AN ACT RELATING TO TIME SHARING PLANS,"
begs leave to report as follows:
The purpose of this bill is to exempt time shares located in Hawaii, but offered for sale outside of Hawaii, from being required to provide Hawaii’s seven day cancellation period or a copy of Hawaii’s disclosure statement. This bill’s intent is to clarify that the sales laws of the jurisdiction in which the sale occurs will apply, but that Hawaii’s sales disclosure and recission laws would not apply.
Testimony in support of this measure was received from the American Resort Development Association, American Resort Development Association of Hawaii, Hilton Grand Vacations Company, and Resort Condominium International (RCI). The Department of Commerce and Consumer Affairs submitted testimony in opposition to this measure.
As affirmed by the record of votes of the members of your Committee on Tourism and Culture that is attached to this report, your Committee is in accord with the intent and purpose
of H.B. No. 18 and recommends that it pass Second Reading and be referred to the Committee on Consumer Protection and Commerce.
