Your Committee on Tourism and Intergovernmental Affairs, to which was referred H.B. No. 1552, H.D. 1, entitled:
"A BILL FOR AN ACT RELATING TO TIME SHARING,"
begs leave to report as follows:
The purpose of this measure is to exclude a time share plan from the definition of "planned community" and to create an exemption and cap for time shares in the usury law.
Testimony in support of this measure was received from the Department of Commerce and Consumer Affairs, American Resort Development Association, The Bay Club, and Pahio Resorts, Inc.
Your Committee finds that this measure would exempt time share plans from the definition of "planned community" in the same manner that current law exempts condominiums and cooperative housing. In addition, the exemption from the interest and usury law is comparable to that of a first mortgage or lien on real property. Your Committee is supportive of these efforts to conform and clarify statutory provisions.
As affirmed by the record of votes of the members of your Committee on Tourism and Intergovernmental Affairs that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1552, H.D. 1, and recommends that it pass Second Reading and be referred to the Committee on Commerce, Consumer Protection and Housing.
