Sir:

Your Committee on Ways and Means, to which was referred H.B. No. 1245, H.D. 1, entitled:

"A BILL FOR AN ACT RELATING TO THE STATE BUDGET,"

begs leave to report as follows:

The purpose of this measure is to require that the state budget contain budget summaries as it moves through the legislative process.

Your Committee has amended the bill by replacing its contents with a measure that provides the following:

(1) Establishes the Litigation Deposits Trust Fund for settlement moneys that are over $100,000, except for those departments able to procure their own legal services (i.e. Department of Commerce and Consumer Affairs);

(2) Deletes from the list of funds exempt from central services fees the Compliance Resolution Fund and the Insurance Regulations Fund;

(3) Allows expenditures from the Works of Art Special Fund to be used for plans, design, construction and equipment for ancillary programs and activities in the Hemmeter building and appropriates $800,000 from the fund for those purposes;

(4) Allows expenditures from the Emergency and Budget Reserve Fund to be used for education;

(5) Makes the following transfers to the general fund:

(A) $1,200,000 from the Agricultural Loan Revolving Fund;

(B) $190,000 from the Animal Quarantine Special Fund;

(C) $1,250,000 from the Financial Assistance for Agriculture Special Fund;

(D) $2,000,000 from the Parking Control Revolving Fund;

(E) $2,000,000 from the Stadium Special Fund;

(F) $5,025,000 from the Capital Loan Revolving Fund, the Hawaii Technology Loan Revolving Fund, the State Disaster Revolving Loan Fund, the Hawaii Innovation Development Fund and the Hawaii Strategic Development Corporation Fund;

(G) $13,000,000 from the Dwelling Unit Revolving Fund;

(H) $8,000,000 from the Hawaii Community Development Revolving Fund;

(I) $3,000,000 from the Rental Housing Trust Fund;

(J) $10,000,000 from the Tourism Special Fund;

(K) $10,000,000 from the Compliance Resolution Fund;

(L) $1,500,000 from the Insurance Regulation Fund;

(M) $1,000,000 from the Environmental Response Revolving Fund;

(N) $200,000 from the Boiler and Elevator Safety Revolving Fund;

(O) $2,200,000 from the Employment and Training Fund;

(P) $400,000 from the Bureau of Conveyances Special Fund;

(Q) $920,000 from the Natural Area Reserve Fund;

(R) $2,500,000 from the Special Land and Development Fund;

(S) $400,000 from the State Parks Special Fund;

(T) $407,000 from the Legal Services Account;

(U) $20,000,000 from the Litigation Settlement Clearance Account;

(V) $300,000 from the Insurance Regulatory Services Account;

(W) $350,000 from the Shippers Wharf Committee Fund; and

(X) $234,000 from the Special Unemployment Insurance Administrative Fund.

The total amount transferred is $88,076,000.

As affirmed by the record of votes of the members of your Committee on Ways and Means that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1245, H.D. 1, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 1245, H.D. 1, S.D. 1, and be placed on the calendar for Third Reading.
