Sir:

Your Committee on Judiciary, to which was referred H.B. No. 1000, H.D. 1, entitled:

"A BILL FOR AN ACT RELATING TO THE JUDICIARY,"

begs leave to report as follows:

The purpose of this measure is to provide the appropriations and authorizations for the operation and capital improvements for the Judiciary for the fiscal biennium 2001-2003.

Your Committee received testimony in support of this measure from the Judiciary, Child and Family Service, The Estate of James Campbell, and two private citizens.

Your Committee carefully considered the written and oral testimony of the Judiciary. Based on the Judiciary's request, your Committee has amended this measure by replacing its contents with the contents of H.B. No. 1000 as originally introduced.

As amended, this measure:

(1) Restores funding cuts to the judicial system program appropriations (Part II), because of the urgent nature of the budget requests;

(2) Deletes certain program proviso language in sections 4, 5, 6, and 7, as being unjustifiably cumbersome and unnecessarily restrictive to the administration and autonomy of the Judiciary;

(3) Inserted two provisos for additional personnel authorizations, although no figures were presented by the Judiciary for the added positions; and

(4) Restored the capital improvement project to build a new court facility in Kapolei, because your Committee believes that a court facility is needed, particularly with the growing leeward Oahu population.

As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1000, H.D. 1, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 1000, H.D. 1, S.D. 1, and be referred to the Committee on Ways and Means.
