Sir:

Your Committee on Water, Land, Energy and Environment, to which was referred Governor's Message No. 168, submitting for study and consideration the nominations of:

JOHN MORGAN and JOHN MYRDAL, Kaneohe Bay Regional Council, for terms to expire June 30, 2004;

begs leave to report as follows:

Upon review of the testimony and the statements submitted by the nominees, your Committee finds that John Morgan and John Myrdal have the necessary character, experience, and qualifications to serve on the Kaneohe Bay Regional Council.

Testimony in support of both nominees was submitted by the Department of Land and Natural Resources.

John Morgan was selected by the Kaneohe Bay Commercial Operators' Association to fill the position of the commercial boating representative to the Kaneohe Bay Regional Council, and to fill a vacancy due to the expiration of the term of the previous incumbent on June 30, 2000. Mr. Morgan has been serving in this capacity on an interim basis, pending approval of the Legislature.

John Myrdal was selected for appointment to the position as the recreational boating representative to the Kaneohe Bay Regional Council through procedures adopted by the Council for this purpose. Previously, no clear or impartial mechanism had been available for identifying and selecting recreational boaters for membership to the Council. Upon the Council's recommendation, the Governor appointed Mr. Myrdal to serve as the recreational boating representative upon the expiration of the term of the previous incumbent. Like Mr. Morgan, Mr. Myrdal has been serving in an interim capacity, pending approval by the Legislature.

As affirmed by the record of votes of the members of your Committee on Water, Land, Energy and Environment that is attached to this report, your Committee, after full consideration of the background, character, experience, and qualifications of the nominees, has found the nominees to be qualified for the positions to which nominated and recommends that the Senate advise and consent to the nominations.
