RESOLUTION
Requesting the auditor to investigate the hawaii community development authority.
WHEREAS, the Hawaii Community Development Authority has recently entered into exclusive discussions with "Adtech", a highly-regarded high-technology company, to relocate to Kakaako Waterfront Park; and
WHEREAS, although the relocation of Adtech to Kakaako would most likely be a positive move for that company and the State, questions have nevertheless been raised as to the propriety of the Authority's exclusive dealings with that company; and
WHEREAS, the fact that the discussions with Adtech are "exclusive" in nature implies that no other company may enter into negotiations with the Authority to develop or relocate to this particular parcel of land; and
WHEREAS, moreover, the lack of public input on this project, and the fact that the exclusive discussions already appear to make the relocation a "done deal", potentially short-circuits both the public procurement process and public hearing process; and
WHEREAS, had the public been permitted greater opportunities to testify as to the propriety or economic wisdom of this project, it is possible that other companies would also have been considered as potential candidates for relocation to Kakaako; and
WHEREAS, although Adtech appears to be a company with great potential and is an important player in Hawaii's new high-tech economy, the closed nature of the Authority's development process may discourage others from doing business in this State; now, therefore,
BE IT RESOLVED by the Senate of the Twenty-first Legislature of the State of Hawaii, Regular Session of 2001, the House of Representatives concurring, that the Auditor is requested to investigate the Hawaii Community Development Authority; and
BE IT FURTHER RESOLVED that the Auditor's investigation is requested to include the following:
(1) A review of whether the Hawaii Community Development Authority violated any laws in entering into exclusive discussions with Adtech, including laws relating to public procurement or public hearings;
(2) A review of whether entering into exclusive discussions, or other type of exclusive negotiations or agreement, as described in this Concurrent Resolution, with a private entity before the public has had the opportunity to provide input on that arrangement, is appropriate public policy;
(3) A review of whether chapter 206E, Hawaii Revised Statutes, relating to the Hawaii Community Development Authority should be amended to prevent the Authority from entering into future arrangements with private entities of an exclusive nature before receiving public input on that arrangement; and
(4) Any other areas that the Auditor finds necessary to review to complete its investigation;
and
BE IT FURTHER RESOLVED that the Hawaii Community Development Authority is requested to cooperate with and provide assistance to the Auditor as may be necessary in the course of the Auditor's investigation; and
BE IT FURTHER RESOLVED that the Auditor is requested to report its findings and recommendations, including any proposed legislation, to the Legislature no later than twenty days before the convening of the Regular Session of 2002; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Auditor and the Executive Director of the Hawaii Community Development Authority.
