A BILL FOR AN ACT
RELATING TO AQUACULTURE.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 183D-1, Hawaii Revised Statutes, is amended by amending the definition of "aquaculture" to read as follows:
""Aquaculture" means the [farming or ranching of aquatic life in a controlled salt, brackish, or freshwater environment, provided that the farm or ranch is on or directly adjacent to land.] propagation, cultivation, or farming of aquatic plants and animals in controlled or selected environments for research purposes, commercial purposes, or enhancement of natural and managed stocks."
SECTION 2. Section 187A-1, Hawaii Revised Statutes, is amended by amending the definition of "aquaculture" to read as follows:
""Aquaculture" means the [farming or ranching of aquatic life in a controlled salt, brackish, or fresh water environment; provided that the farm or ranch is on or directly adjacent to land.] propagation, cultivation, or farming of aquatic plants and animals in controlled or selected environments for research purposes, commercial purposes, or enhancement of natural and managed stocks."
SECTION 3. Section 219-2, Hawaii Revised Statutes, is amended by amending the definition of "aquaculture" to read as follows:
""Aquaculture" means the [production of aquatic plants and animal life in a controlled salt, brackish, or freshwater environment within the real property for which real property taxes are assessed and paid by the owner or producer.] propagation, cultivation, or farming of aquatic plants and animals in controlled or selected environments for research purposes, commercial purposes, or enhancement of natural and managed stocks."
SECTION 4. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 5. This Act shall take effect upon its approval.
