A BILL FOR AN ACT

 

relating vehicle safety inspections.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that the rental and U-drive motor vehicle industries, as a matter of sound business practice, regularly inspect and maintain their vehicles far in excess of what is required by law or recommended by the manufacturer of the motor vehicle. Although many of their motor vehicles are less than two years old, regular inspection and maintenance will increase the resale value of a vehicle and decrease the chance of an equipment-related crash (and subsequent lawsuit). Maximizing profits and minimizing liabilities is what makes a business successful.

The legislature can help the rental and U-drive motor vehicle industries to further maximize their profits by raising the age at which these motor vehicles must undergo a biannual vehicle safety inspection from one year of age to two years of age. In return for this help, the rental and U-drive motor vehicle industries can further minimize their liabilities—and in the process protect the health, safety, and general welfare of the public—by ensuring that every one of their vehicles is safe and sound whenever it is on the highways.

SECTION 2. Section 286-26, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

"(a) The following vehicles shall be certified as provided in subsection (e) once every six months:

(1) Ambulances;

(2) Trucks, truck-tractors, semitrailers, and pole trailers having a gross vehicle weight rating of more than 10,000 pounds;

(3) Buses;

(4) Rental or U-drive motor vehicles [one year] two years of age or older; and

(5) Taxicabs."

SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
